Andricia Hinckemann-Dlamini is a Partner in the Litigation and Dispute Resolution practice group. Her practice focuses on general commercial litigation including advising clients in the healthcare and mining sector on various issues such as alternative dispute resolution processes, drafting legal opinions relating to contractual disputes and assisting with instituting legal proceedings.
Andricia has gained valuable experience in relation to advisory and regulatory compliance matters and provides strategic advice including licensing and registration of medicines and scheduled substances in terms of the Medicines and Related Substances Act 101 of 1965 as amended as well as assisted with instituting or defending review applications in relation to decisions taken by regulatory bodies.
She has particular experience in product liability matters, advising international pharmaceutical companies in product liability cases relating to medicines, including anesthetics and other medicines, as well as medical devices. She advises clients on managing legal risks that may arise in the product liability and health practice area, including engaging with and assisting clients in reaching cost-efficient settlements in order to prevent large product liability claims before they arise; advising clients on the process of class actions in South Africa including certification of a class action; assisting and defending manufacturers in relation to class action lawsuits; advising and assisting clients with product recalls and ensuring adherence with the applicable rules and regulations.
She also provides advice in the area of traditional communities and traditional councils in mining and leadership disputes and has a good understanding of the Traditional Leadership legislation. Her advice includes various matter in relation to traditional communities on various issues relating to leadership, governance, development projects and protection of the community assets.
