Overview

On December 5, 2011, the Ontario Court of Appeal released a long-anticipated decision concerning the new summary judgment rules, which had been recently expanded, with the apparent intention of making summary judgment more available. In the wake of the Court's decision, significant concerns have arisen as to whether the decision is consistent with the spirit and apparent intention of the new rules. This seminar, designed for in-house counsel involved in managing litigation, will address the following:

  • Why in-house counsel should be concerned over a decision about the rules of civil procedure
  • How the new decision has changed the landscape
  • Some practical guidance for claim evaluation and management
