Harper Announces New Foreign SOE Investment Policy: How Will it Impact Future Foreign Investment in Canada?
Last week’s statement by Canada’s Prime Minister Harper that the CNOOC/Nexen and Petronas/Prospect Energy approvals “are not the beginning of a trend, but rather the end of a trend” sent a signal to the investment community that future investments involving foreign SOEs are going to be subjected to a more onerous review process under the Investment Canada Act. However, except for future SOE takeovers of Canada’s oil sands companies being unwelcome, the revised SOE policy was short on specifics raising more questions than it answered.
Guy Giorno, former Chief of Staff to the Prime Minister of Canada, and Douglas New, a leading specialist in the area of foreign investment regulation will comment on the policy change and what it will mean for both foreign SOEs interested in investing in Canada and Canadian business generally. The webinar will be moderated by Richard Steinberg, International Chair of Fasken Martineau's Securities and Mergers & Acquisitions Practice Group.

Speakers
Guy Giorno is a partner with Fasken Martineau practising public law with an emphasis on accountability and ethics laws. During the 1990s, he routinely represented public-sector institutions (respondents) in freedom of information appeals. Guy now focuses on compliance and best practices (helping institutions to achieve greater transparency and accountability) and on helping requesters to exercise their rights to obtain government records under freedom of information/access to information legislation.
Before joining the firm, Guy served as Chief of Staff and Legal Counsel to the 22nd Premier of the Province of Ontario. He later also served as Chief of Staff to the Prime Minister of Canada.
Much sought-after as a speaker, he has delivered presentations and speeches to numerous audiences and organizations. His analysis appears frequently in the media.
Douglas New is a senior partner with Fasken Martineau with over 30 years of experience in the area of Canada’s foreign investment laws. During his career, he has represented numerous foreign investors before the Investment Review Division and its predecessor, the Foreign Investment Review Agency (FIRA), testified as an expert witness on Canada’s foreign investment laws before a US Congressional hearing into the North America transportation industry, acted a special legal advisor to FIRA, lectured and written on Canada’s foreign investment laws including as a contributing author of a number of textbooks, and served as a legislative draftsperson, having most recently drafted foreign investment review regulations for a foreign government.
