Overview

Concerns have long been expressed that some individuals and corporations may use their financial might to improperly silence debate through meritless defamation lawsuits, also referred to as “strategic litigation against public participation” (“SLAPPs”). The Ontario government’s proposed Protection of Public Participation Act, 2013 (the "PPPA"), which could be in force by the end of the year, adopts specific measures against SLAPPs. What will the PPPA mean for free speech in Ontario? What will its implications be for corporations properly concerned to protect their reputations from false attacks? What will its impact be on the media?

Our panel includes leading professionals from the defamation, media and litigation fields, including Peter Downard, a member of the SLAPP Advisory Panel to the Attorney General of Ontario. The panel will discuss:

  • Effective reputation protection and trends in defamation law in the anti-SLAPP era 
  • Experience with anti-SLAPP legislation in other Canadian and foreign jurisdictions 
  • Defining a SLAPP suit and Ontario’s PPPA: the purpose and substance of Ontario’s approach
