Overview

A thoughtful and well-drafted dispute resolution clause can mean the difference between the efficient and timely resolution of a disagreement and a long, drawn out and costly court and/or arbitral proceeding. Picking the right clause requires strategic thinking and detailed knowledge about the available options. In this session, we look at the topic of picking the right dispute resolution clause from the perspective of corporate counsel, with a particular focus on the mining industry.

The topics we will address include:

  • Key questions to ask when considering dispute resolution clauses
  • When and why to choose arbitration over litigation
  • Picking the right clause (and some cautionary tales)
