Canada, the United States and Australia, all have foreign investment laws that have the potential to impact on mining sector transactions and government concerns with factors such as the direct or indirect participation of state-owned enterprises in mining ventures and possible national security issues have added to the complexity of successfully undertaking foreign investments in these countries.
Using hypothetical transactions in the natural resources sector, the panelist will analyze and compare the foreign investments laws of Canada, the United States and Australia, as well as provide updates on recent changes to and developments in the regulation of foreign investment and the administrative approaches be taken by the governmental agencies responsible for the administration of these laws in their respective jurisdictions.
