Increasingly, mining companies are teaming up with their suppliers to develop suitable technology for their mining operations. Often, the supplier provides the basic (or background) technology while the mining company provides the platform, the resources and the practical development expertise to allow the supplier to further develop or improve the technology and ensure that it can be used economically on a commercial scale. While this collaboration between the parties can lead to the creation of new and innovative technologies, it can also give rise to a host of intellectual property issues relating to ownership and exploitation of the newly-developed technology, and the protection of the underlying intellectual property rights. This panel will discuss the intellectual property implications in co-development arrangements and will share practical insights as to how to approach technology co-development ventures with a view to extracting the most value from the newly-developed technology.
