The Impending Changes to Federal Environmental Law in Canada: What are the Implications

Major changes are coming to cornerstone environmental legislation in Canada.  Changes to the federal Fisheries Act and federal environmental assessment legislation will affect major projects and project proponents in this country.
While some of the announced changes will deliver process improvements that will benefit project proponents, other changes are likely to increase regulatory risk by adding to the complexity, likelihood of delay, and cost of obtaining federal environmental approval and compliance.  In this session, we will:

• Highlight the most important changes to the Fisheries Act, and to environmental assessment under a new Impact Assessment Act
• Discuss changes to standard for protection of fish, and the implications for obtaining approvals under, and compliance with, the Fisheries Act
• Discuss changes to the scope of environmental assessment, affecting the number and types of projects that are reviewable, and changes to the standards for approving projects
• Discuss new expectations for Indigenous participation in the regulation of infrastructure that impacts fish and in EAs, including the role of Traditional Knowledge.
• Guidance on how to work with your professional advisors to secure Fisheries Act approvals and survive an EA with your project (and budgets) intact.
