Canadian mining companies are facing the prospect of novel claims and potential legal liability for human rights incidents at their foreign operations. As a result, the human rights footprint of Canadian mining companies operating overseas is under increased scrutiny by government, civil society groups, ESG investors, and plaintiffs-side counsel. Mining companies need to go beyond the generalities to protect themselves from these emerging risks. This session will offer concrete “lessons learned” from the Nevsun litigation, guidance on how Canadian mining companies can better assess their human rights-related risks when operating overseas, and practical, business-oriented legal strategies to manage human rights due diligence and related risk exposures.
