Wage Fixing and No Poach Agreements - Preparing for the new Criminal Prohibition

Overview

The passage of the Budget Implementation Act in June brought with it various amendments to the Competition Act. Of particular significance is the creation of a new criminal offence prohibiting wage-fixing and no-poach agreements among employers in relation to their employees. Although the amendment has been passed, the coming into force of this new criminal prohibition was delayed until June 23, 2023.
