Overview

A person’s most important last wish after their death often concerns how they want their assets to be distributed. Yet, this often becomes a topic of litigation. With the ability to determine your dispositions through numerous vehicles, including a will, an inter vivos trust, a direct beneficiary designation, a joint tenancy, and other arrangements, the true and enforceable last wish of a person can be controversial.

This session will discuss how courts view a person’s testamentary intentions, which instruments will be enforced and which will not, along with the consequences when a document or arrangement is not recognized. This information will help people make effective estate plans and understand the consequences when a plan is not valid.
