Overview

Kerry Kaukinen is a member of the Indigenous Legal Matters and Environmental groups in Vancouver. Her practice focuses on environmental litigation, administrative law and regulatory compliance. She has appeared before several levels of court in British Columbia, the Yukon Territorial Court, the Federal Court of Appeal and administrative tribunals.

Kerry works with clients to effectively navigate the sensitivities and processes involved in permitting, environmental assessment, and Indigenous consultation. She represents clients on judicial review matters, injunctions and other disputes often involving Aboriginal and Environmental law elements.

Kerry advises clients under investigation for regulatory and environmental offences and has defended clients in regulatory prosecutions and contested sentencing hearings.

  • Defence of unprecedented federal environmental prosecution for Teck Coal, [Case - Teck Coal Limited], The Federal Crown approved charges under the Fisheries Act, alleging that Teck Coal had deposited or permitted the deposit of a deleterious substance, coal mine waste rock leachate, from two of its mines over a ten year period.
  • Husby forest Products in injunction to restrain the defendants from blockading an arterial forestry services road, [Case - Husby]
  • Vancouver International Airport and Musqueam Indian Band sign momentous agreement for shared benefit, [Case - Vancouver Airport Authority]
  • Ongoing litigation-related matters for Mount Polley Mining Corporation and Imperial Metals Corporation, [Case - Imperial Metals Corporation and Mount Polley Mining Corporation], We represent Mount Polley Mining Corporation and Imperial Metals Corporation in multiple litigation-related files relating to the tailings dam for the Mount Polley mine, which collapsed in August 2014.
  • Site C Project Regulatory Advice, [Case - BC Hydro and Power Authority], Advised BC Hydro & Power Authority with various regulatory advice on the Site C project.
  • Mining company is granted injunction for prevention of blockades by protestors, [Case - Ontario Pension Board]
