Overview

Mishaal is a member of Fasken’s Insolvency & Restructuring group and the Banking & Finance team.

In his insolvency and restructuring practice, Mishaal advises clients on credit and debt collection, bankruptcies, receiverships, formal and informal debt restructurings (including under the Companies’ Creditors Arrangement Act and Bankruptcy and Insolvency Act), commercial foreclosures, and realizations under the Personal Property Security Act.

Mishaal also works with banks, credit unions, private lenders and borrowers on debt-financing and other secured transactions, including asset-based lending, syndicated transactions, acquisition financing, real estate financing, distress financing, and multi-jurisdictional financings.

The receivership proceeding is ongoing in the Yukon Supreme Court.

There has been an overall trend towards prioritizing environmental obligations. Reverse Vesting Orders continue to be sought, with Canadian courts cautioning that they remain extraordinary relief. In the fall, the Quebec Court of Appeal issued its ruling in the Chronometriq matter, recognizing a court’s power to grant interim financing charges priority over CRA’s deemed trust claim in proposal proceedings under the Bankruptcy and Insolvency Act.
