Ms. Karine Fournier, a lawyer specializing in employment and labour law at Fasken Martineau, studied the legal aspect of a very current issue: can a landlord prohibit a tenant from smoking because it risks disturbing the neighbours?
Although she insists that she is not “waging a personal war against smokers,” Ms. Fournier admits she is sensitive to the cause: two of her family members died from tobacco-related illnesses.
“It’s also my pro bono side that drives me to reflect legally on these issues,” she said.
“Respecting the privacy of smokers is limited by their neighbours’ right to enjoy their housing in peace,” she explains, stressing that health comes before other rights.
