With the growing significance of defined contribution (DC) plans in Canada, industry associations and regulators are now expressing concern about litigation risk, says Peggy A. McCallum, a partner with Fasken and leader of the firm’s pensions and benefits group. Speaking at the Fasken Institute ‘Pensions & Benefits and Litigation Seminar,’ she said the concerns expressed – by agencies such as the Financial Services Commission of Ontario (FSCO), the Office of the Superintendent of Financial Institutions (OSFI), and the Canada Revenue Agency (CRA) – include decumulation, fees, lack of member understanding, and appropriate investments.
