Fasken wins an Annual Turnaround Award

Overview

Toronto (Canada) – Fasken has won an Annual Turnaround Award for ‘Energy Deal of the Year (Over $1B)’ for our role in the Recapitalization of Tervita Corporation (“Tervita”). These awards recognize the leading transactions, firms and individuals in restructuring, distressed investing and turnaround deal-making.

The award will be handed out tonight at an event in Palm Beach, FL at the 2018 Distressed Investing Summit. Organized by The M&A Advisor, the nominees represent over 250 companies. The winners were chosen by an independent jury of industry experts.

Fasken co-represented Tervita on a recapitalization transaction on December 14, 2016, which was part of its court-approved plan of arrangement under the Canada Business Corporations Act. This reduced Tervita’s total debt from $3.6 billion to $475 million. The recapitalization transaction was led by John Grieve, QC and included Travis Lysak, Kibben Jackson, Danielle Toigo and Fergus McDonnell (Insolvency), Michael Black (Energy/Corporate) and Brent Lewis (Banking). Fasken was also Canadian counsel to Tervita on a senior notes offering. That team was led by Sarah Gingrich and Georald Ingborg, and included Sandra Malcolm and Perry Feldman (Securities), Jon Holmstrom and KC Miu (Banking) and Clarke Barnes (Tax).
