Simon Hitchens practices in all areas of trademark and copyright law, with a particular focus on brand protection. Simon regularly assists clients with trademark prosecution, portfolio management, the development of brand protection strategies and trademark opposition and expungement proceedings. He also advises on enforcement of rights including trademark and copyright litigation, licensing of IP rights and conducting due diligence for the disposition of intellectual property.
Regularly appearing before the Trademarks Opposition Board, Simon has extensive trademark opposition and IP litigation experience in Canada and has acted for clients before the Federal Court of Canada and the Federal Court of Appeal.
Simon manages and enforces the trademark portfolios of clients that span diverse sectors including the financial services, commercial real estate, retail, chemical, healthcare, automotive, clothing and food service industries. Simon manages trademark portfolios for clients both nationally within Canada and internationally across numerous jurisdictions. With wide experience in brand protection and enforcement issues in the world of advertising, Simon has developed a focus on social media and other online branding issues. He also represents clients with respect to domain name disputes and enforcement of their underlying trademark rights.
Before joining Fasken Simon spent nine years practising at another leading Canadian firm and began his career in London, England in the IP department of a globally recognized law firm.
