KVR Rail Lands transfers to Penticton Indian Band in partnership with Canadian Pacific Railway and Government of Canada

The agreement reached between the Penticton Indian Band (“PIB”), Canadian Pacific Railway (“CP”) and the Government of Canada has the potential to end decades of feuding over the former Kettle Valley Railway (“KVR”) line in Penticton, BC. The agreement was reached through a collaborative effort between CP, PIB and the Government of Canada. Upon completion of the agreement, approximately seventeen kilometres of linear rail corridor will be transferred to PIB in fee simple. It has not yet been determined how the land will be used, but brings potential economic benefits to both PIB and surrounding communities. Fasken Martineau was counsel to Canadian Pacific with a team that included Carmine Boskovich.
