Overview

A First Nations group and independent power project proponent applied for judicial review of a direction given to BC Hydro pursuant to a commitment made by a minister of the provincial government to in relation to a run of the river power project. The part of the application seeking relief against BC Hydro was dismissed by the Supreme Court of BC and was appealed to the BC Court of Appeal The BC Court of Appeal dismissed the appeal. The Supreme Court of Canada dismissed an application for leave to appeal the BC Court of Appeal decision. Fasken Martineau was counsel to BC Hydro throughout the litigation, with a team led by Chuck Willms that included Tariq Ahmed, Holly Brinton and Kaleigh Milinazzo.
