Jonathan was a key member of the Fasken legal team for Swiss Reinsurance from 2017 to 2019 in respect of a USD$25 million reinsurance claim involving defective roof tiles claims in the US. The litigation was settled on the eve of a 145-day trial after the legal team obtained a series of ground-breaking discovery and deposition orders, which uncovered previously undiscovered evidence, changing the landscape of the litigation and ultimately leading to a favourable resolution for Swiss Re. The case involved many novel legal issues involving reinsurance and novel procedural orders and mechanisms due to the unique nature of the case.
