Prosecution for criminal negligence causing death arising from a workplace fatality

Overview

In 2019, Pieter Kiewit Sons (Kiewit), Timothy Rule and Gerald Karjala, were charged with criminal negligence causing death under s.220 of the Criminal Code with respect to a workplace fatality at the Kiewit hydroelectric project near Toba Inlet.

In September 2021, shortly before the trial was to commence, the charges were stayed by the Crown, which had determined the available evidence no longer satisfied the charge assessment standard for the continued prosecution of the company or individuals.
