We represent PricewaterhouseCoopers Inc. (“PwC”) in its capacity as receiver and manager of a pulp mill in Port Alice, BC. PwC was appointed as receiver and manager to ensure the pulp mill was responsibly maintained and, ultimately, decommissioned, as well as to sell any remaining assets of value.
This case is particularly complex because the applicant for the appointment of a receiver was the Province of British Columbia to address the abandonment of the pulp mill by its owner, Neucel Specialty Cellulose Ltd. The Province had been incurring significant costs to remedy environmental and other concerns arising from the abandonment of the pulp mill. Complicated issues arose relating to environmental management, procurement and infrastructure maintenance, as well as disputes with the union members formerly employed at the mill. Engagement with the local First Nations was also required throughout.
Fasken advises PwC in the insolvency proceedings with a team led by Fergus McDonnell and includes Kibben Jackson, Mishaal Gill (Insolvency and Restructuring) and Rob Legge (Corporate/Commercial).
