Fasken represented FLS Transport in the context of a major lawsuit concerning restrictive covenants and unfair competition. Injunctions were filed in July 2020 and renewed thereafter. However, one renewal was refused and, consequently, FLS appealed this decision. After being granted the permission to appeal – which is the first time in 20 years in similar circumstances - the case was heard before the Court of Appeal of Québec on November 27, 2020 where Fasken successfully represented FLS Transport.

Following an injunction procedure, FLS Transport brought forward an action for damages against former employees and competitor who violated their restrictive covenants. The damages are being currently assessed but we reasonably assume that Plaintiff will claim millions. 

FLS Transport is a long-time client of Fasken’s and one of the largest companies in the North American freight business. It is recognized as #23 on Transport Topics index of Top 3PLs and has 18 offices and 425 employees across North America. Overall, it boasts a network of over 54, 000 carriers and 400,000 trucks.
