Conseil de la magistrature du Québec

Representation of the Judicial Council of Québec in the context of the Reference pertaining to the monetary competence of the Court of Québec (provincial court) over civil matters and its competence over administrative appeals. The Québec Legislature established a system by which certain civil and administrative cases would be heard by the Court of Québec composed of provincially appointed judges.

This led to a constitutional challenge and to a debate before seven judges of the Court of Appeal (Québec’s highest Court). Last September, the case was heard by the Supreme Court of Canada and is currently under advisement.

Our team led by Marc-André G. Fabien, Ad. E. and Vincent Cérat Lagana and including Jesse Hartery, Marc-André Boucher and Catherine Simonet was mandated by a committee of provincial judges to represent the main judicial organization in Québec, the Judicial Council of the Province of Québec, and defend the competence and jurisdiction of the Court of Québec.
