Fasken successfully represented the City of Blainville against allegations by the Canadian Union of Public Employees (“CUPE”) that the city had illegally carried out temporary layoffs of permanent Union employees covered by job security packages.
Following the outbreak of the COVID-19 pandemic in Canada in March 2020, the Government of Québec implemented specific measures to control the spread of the coronavirus disease, while a public health state of emergency was declared for the entire province of Québec, leading to the closure of all businesses, industries and municipal facilities. Hence, the City of Blainville began, on a voluntary basis, a series of temporary layoffs of permanent employees.
In its decision rendered on November 27, 2020, the arbitration tribunal rejected CUPE’s two grievances and thus ruled in favour of the City of Blainville.
