Fasken represented the interests of CAA-Québec Auto and Home Insurance Inc. in a class action brought against a number of insurers in the province.
The application for authorization of the class action sought to obtain damages related to allegations that insurers would use a scheme in which they provided to their policyholders who had suffered damages covered by their insurance policies a pre-established list of disaster repair contractors, while not disclosing to policyholders that, in exchange for the listing, the contractors in question had to pay the insurers a cash rebate.
This litigation affects the entire industry and is a major class action in Québec.
