Overview

Client

Eastern Platinum Limited

Eastern Platinum Limited and its subsidiaries commenced an action in the British Columbia Supreme Court against the former officers and directors of the companies. The action arose as a result of a change of control of the Board that occurred in 2016. Eastern Platinum claimed damages for breach of fiduciary duty, negligence, misrepresentation, civil conspiracy, unjust enrichment, and conversion.

On June 21, 2021, our client announced that it had agreed with the defendants and certain other parties to settle and dismiss its outstanding lawsuits and to settle related disputes. The terms of the settlements are confidential and no party to them has admitted any wrongdoing or liability.

Tracey M. Cohen, Q.C. and Cindy Phillips were the lead members of the Fasken team that represented Eastern Platinum.
