Shaquille Murray-Lawrence, an athlete with the Bobsleigh Canada Skeleton (BCS) Senior Bobsleigh Team, appealed BCS' decision to nominate him as an alternate for the 2022 Olympic Team (the "Decision"). Mr. Murray-Lawrence alleged that the Decision was grossly unreasonable and that, in making the Decision, BCS exercised its discretion for an improper purpose. Following an extensive review of the BCS Olympic Team nomination procedures and the evidence of the parties, the Arbitrator held that BCS properly applied its nomination procedure and that Mr. Murray-Lawrence had neither established that the Decision was unreasonable nor that he should have been selected for the 2022 Olympic Team. The appeal was dismissed.
Fasken advised Bobsleigh Canada Skeleton with a team that included Arif Chowdhury and Desmond Mitic (Litigation).
