Overview

Michael Levy, a quadriplegic victim of crime, claimed the Crime Victim Assistance Program (CVAP), an agency of the Provincial Government, breached an agreement reached in 2009 to fund his care. The Defendant denied the existence of an agreement and argued that any agreement would be an impermissible fetter on CVAP’s discretion. The Court ruled in favour of Mr. Levy on all issues, and awarded him “special costs” throughout.
