Mount Polley Mining Corporation (“MPMC”) and Imperial Metals Corporation was wholly successful in defending the claims made against it and in prosecuting its counterclaim at issue in the first phase of the arbitration. The arbitration team was comprised of Brook Greenberg, QC, Gavin Cameron, Oliver Leung, and Oliver Verenca.
MPMC was then successful in resisting the contractor’s application for leave to appeal from the arbitrator’s award.
Brook Greenberg, QC and Oliver Leung represented MPMC in the dredging contractor’s petition seeking leave to appeal the arbitral award from the first phase of the arbitration. The application for leave to appeal was dismissed by Justice McDonald on June 28, 2022.
