At the highest court in Canada, Fasken prevailed on behalf of our client, Carleton University, in one of only three private pension plan cases to be heard by the court. In a rare case involving the legal regime applicable to an absentee, the Supreme Court of Canada confirmed the claim from the pension plan manager to recover pension benefits paid for several years to an individual that was dead, in order to benefit to the other pensioners.
