EMX Royalty Corp. ("EMX"), was previously the holder of a number of mineral licenses in northern Ontario, certain of which were subsequently optioned to Golden Goliath Resources Ltd. (“Golden Goliath”). In turn, Golden Goliath made applications for, and was granted, certain work permits to conduct drilling, stripping, geophysical surveying and line cutting (the “Permits”).
In November 2021, Grassy Narrows First Nation (“Grassy Narrows”) initiated judicial review proceedings against the Government of Ontario (“Ontario”) seeking to quash the issuance of the Permits. Grassy Narrows alleged in its application that Ontario failed to discharge its duty to consult with Grassy Narrows before issuing the Permits. Given its interest in the underlying subject-matter, EMX brought a motion to intervene in the proceeding. With Fasken’s assistance, the matter, as it related to EMX, was ultimately resolved by agreement with the Ministry of Mines. The judicial review proceeding was also subsequently resolved in March 2024.
