Fasken represented a company active in the development of electric vehicle motors and related power systems. Many of these components (e.g., inverters) have dual-use capabilities and can be used both in a civilian capacity or for nuclear military purposes. The client was assessing manufacturing operations and jurisdictions with favorable export licensing regimes since cross-border sales are a significant element of the company's operations. Our mandate was to advise the client's US counsel on numerous export control licensing obligations and requirements of the Canadian Nuclear Safety Commission and other Canadian government departments.
