Fasken represented Rimex Supply Ltd. with a team comprised of Chris Elrick and Cindy Phillips, Commercial Litigation. The plaintiff, a former plant and operations manager for Rimex, brought a summary trial application seeking damages for wrongful dismissal. Rimex succeeded in its argument that issue estoppel did not apply to the decision of the Employment Standards Branch in which the plaintiff was awarded compensation based on lack of cause. The remaining issues were found not suitable for summary trial.
