Fasken represents Cision Inc. in an action against Meltwater Inc. for copyright infringement claiming tens of millions of dollars and an injunction to stop Meltwater from using newspaper content without paying any royalty to the newspaper Editors.
Meltwater operates a media monitoring and clipping service where they sell subscriptions to customers and give access to the content of many Canadian newspaper without the consent of the Editors and without paying anything.
The Court will have to decide whether such a clipping service infringes on the Editors copyright and if the exerts communicated represent a substantial part of the work. Moreover the notion of fair dealing will be central to the issues.
