Overview

Canadian mining companies have been involved in international exploration and development for decades, but many ventures are now proving disappointing for reasons other than commodity prices. In addition to the customary risks of developing projects, the risks of war, changing political conditions, loss of title through expropriation or nationalisation, unenforceability of contractual rights, inadequate courts and community disturbances have changed the investment climate. Lessons can be learned from both disappointment and success.

Join us for breakfast on PDAC Monday when we will discuss practical issues, challenges and solutions to managing the polycentric risks of investment-related mining disputes, particularly in developing countries. A multi-disciplinary panel will discuss the following topics:

  • Structuring foreign investments to maximize treaty protection
  • Securing access to international arbitration in case of dispute 
    • Arbitration clauses
    • Mining laws, investment laws and treaties 
  • Government relations in the host state in the face of potential disputes or impending or actual policy changes 
  • Creative strategies for managing arbitration and resolving disputes
