While the desirability of entering into Impact Benefits Agreements (IBAs) for new projects is now quite well understood, there remains some uncertainty in the industry when it comes to negotiating agreements for existing, permitted facilities. Mining companies and Indigenous communities are now interested in understanding the drivers and challenges of these agreements. Fasken has been at the forefront of these developments in mining and other industries across Canada, including with our involvement in the ground-breaking work for Vancouver International Airport. This session will discuss the increasing pressure on companies and their increasing willingness to consider this option for existing facilities, as well as the benefits and potential pitfalls of “opening Pandora’s box”. If done well it can advance reconciliation, enhance existing relationships and set the stage for future development and expansion. Our panel will be made up of lawyers with considerable expertise in the area as well as a client who has successfully walked the path to an IBA for an existing facility.
