The past year has been dizzying for employers in federally-regulated industries, who are struggling to keep pace with all the legislative changes. In this Federal Sector Update, we will recap the most significant changes to labour and employment laws and highlight the key changes on the horizon. The panel from Fasken will be joined by Derrick Hynes of FETCO, an employers’ association comprised of federally regulated employers within the transportation and communications sectors, who will provide insight from his consultations with lawmakers about these changes.

Specific topics include: 

  • The amendments to the Canada Labour Code (“Code”) which came into effect September 1, 2019, including new entitlements related to scheduling, leaves of absence, flexible work arrangements, breaks and rest periods;
  • Additional changes to the Code, expected in 2020, including restrictions on paying employees differently on the basis of employment status (e.g. full-time vs. temporary employees) and new obligations related to the prevention of violence and harassment in the workplace;
  • The new Accessible Canada Act and what we expect to see in the forthcoming regulations;
  • The new Pay Equity Act coming into force in 2020 and how to prepare for the long and winding road ahead;
  • The proposed new pay transparency requirements under the Employment Equity Act; and
  • The potential impact of the federal election on these legislative changes.
