The Organization for the Harmonization of African Business Law (“OHADA”) Space comprises 17 state members: Côte d’Ivoire, Cameroon, Benin, Burkina Faso, the Central African Republic, Congo-Brazzaville, the Democratic Republic of Congo, Gabon, Guinea-Bissau, Guinea Conakry, Equatorial Guinea, Comoros, Mali, Niger, Senegal, Chad and Togo. Our speakers have a comprehensive understanding of some of the most legal particularities to OHADA, related to introducing and developing client projects, especially in the mining industry.
This session will generally present the applicable legal framework, comparable views with Canadian corporate laws and will provide practical tips regarding the most common commercial or corporate legal issue within the OHADA Space. We will then explore the main risks related to investing in Africa and examples of solutions to limit the negative impacts, the particularities and constraints of "Doing Business" in the OHADA Space with a parallel with Canada, key points to be analysed during the legal due diligence in the context of a Mining transaction and Dispute Resolution Mechanism in the OHADA Space: Local Courts vs CCJA Arbitration. A particular emphasis will be also on how to partner with trustworthy local stakeholders to obtain certification or administrative authorizations required to complete your business activities.
