• 9:05 - 9:45 am - The Long Term Care COVID-19 Commission - What should LTCs expect? - Jennifer McAleer, Partner
  The Ontario government recently appointed a three-person Commission to investigate the spread of COVID-19 within long-term care (LTC) homes, how residents, staff and families were impacted and the adequacy of measures taken by the province and other parties to prevent, isolate and contain the spread. We will discuss the Commission’s mandate and what LTCs might expect from the Commission. The Commission’s Terms of Reference specify that it may request, review and consider any existing records or reports relevant to the mandate, including the Final Report and Recommendations from the Public Inquiry into the Safety and Security of Residents in the Long-Term Care Homes System dated July 30, 2019 (the “Wettlaufer Report”). We will look at changes that have been implemented since the release of the Wettlaufer Report, and the potential impact on the COVID-19 Commission.

  As health care organizations are being asked to reflect on how to improve their COVID-19 response ahead of a potential second wave, they are also being targeted with an unprecedented number civil litigation claims. In order to honestly and critically assess their performance, health care organizations must have confidence that their quality assurance reviews cannot be used against them. This seminar will offer practical guidance on what steps can be taken to protect your organization’s quality assurance reviews during the pandemic and beyond.
• 10:15 - 10:45 am - Granny Cams - Drafting Enforceable Surveillance Policies -Daniel Fabiano, Partner
  Requests to install “granny cams” are on the rise. In addition to monitoring the quality of care a loved one is receiving, families are requesting cameras due to COVID-19 visitation restrictions – with two-way voice communication as a means of staying in touch. The use of cameras, particularly where audio is being captured, gives rise to a variety of legal concerns, notably under privacy laws and the Criminal Code. This session will discuss those legal concerns, and how to mitigate risk through effective policies.
