• 8:35 - 8:55 am - Privacy Breaches – Mitigating Risks and Meeting Your Statutory Obligations - Daniel Fabiano, Partner 
  Privacy breaches, particularly cybersecurity incidents, have become commonplace. Ransomware attacks, email compromise, and service provider lapses regularly make the news. This session will provide a refresher on the current state of statutory requirements for the health sector relating to breaches, and also share insights and risk mitigation measures arising out of recent litigation.
• 8:55 - 9:15 am - Consent and Capacity Refresher - Lily MacLeod, Associate
  The pandemic has raised unique challenges and issues related to consent, capacity and substitute decision making. This session will provide a refresher on how to determine if someone has capacity to (1) make personal care decisions and (2) give a power of attorney. It will also outline the statutory provisions that govern capacity assessments and discuss various COVID-19 related issues that substitute decision makers may encounter, with a focus on key provisions under the Substitute Decisions Act and the Health Care Consent Act.
• 9:15 - 10:00 am - The Road to Opening – Lessons Learned from Opening a New Long-Term Care Home in Ontario
  The Ontario government committed to creating 30,000 new long-term care beds over the next decade. There are currently 80 different projects, 60 of which involve the construction of a brand-new buildings, underway to accommodate the almost 12,000 new beds that have already been allocated. These projects can bring many new, or long-forgotten, challenges to operators. Join Lynne Golding, Leader of Fasken’s Health Law Group, as she guides a panel discussion with Revera Inc.’s Kim Kowalik, Vice President, Legal Services, Carmen DiMauro, National Director Strategic Operations, Long Term Care and John Mitchell, Senior Manager, Construction, about Revera’s experience opening a new long-term care home in Ontario. The discussion will examine the following topics from a regulatory, operational and construction perspective:

• 10:00 - 10:20 am - Health and Safety Update - Erin Porter, Partner and Lennie Lejasisaks, Associate
  Healthcare organizations have been subject to a rapidly changing health and safety landscape over the past year-and-a-half. This session will provide an update on relevant health and safety issues and will include a timely discussion on vaccination policies, in particular privacy concerns and enforcement.
• 10:20 - 11:10 am - Legal issues in the use of Telemedicine in Long-Term Care and other Seniors Homes - Laurie Turner, Partner
  The use of telemedicine in seniors and long-term care homes, like other care settings, increased dramatically during COVID. In this session, Laurie Turner will discuss legal issues relating to the use of telemedicine in those settings by various health care providers including those relating to liability, payment for services and professional standards.
