With the Russian invasion of Ukraine, sanctions law has leapt to the forefront of due diligence across all domains of business law from financial transactions to M&A. The global mining industry, with its intricate cross-border relationships and highly integrated supply chains, is particularly vulnerable to sanctions enforcement.
The law of sanctions is complex, politically-charged, and consequential. Failure to understand and adhere to these regulations can cost more than dollars: they carry potential penal consequence. Critical mineral supply is intimately linked to the security of states and any sustained war effort. But that very supply is now potentially hampered by the sanctions restrictions imposed by multiple allied nations in respect of war in Ukraine.
