Managing absenteeism in the workplace remains as challenging an issue as ever. HR professionals must take care to distinguish between culpable and non-culpable absences, which are sometimes intertwined. Human rights considerations must be taken into account at every step in connection with disabilities and family care. In this seminar, we will provide practical advice to employers and human resources personnel for managing disabilities in both unionized and non-unionized workplaces. We will also take a closer look at common mental health issues (stress, depression, anxiety) and their impact on businesses, while discussing how employers can manage absences and return to work from the perspective of the health care provider.
In this session we will:
- Examine employers’ obligations vis-a-vis employees with disabilities and other issues impacting their attendance
- Review the accommodation process, including the duty to enquire with respect to certain disabilities such as addiction
- Discuss appropriate methods for dealing with uncooperative employees and treating physicians, and vague or incomplete medical documentation
- Review the test for the “frustration of contract” due to disability, both provincially and in the federal sector
- Discuss challenges more specific to accommodating a mental health disability along with obstacles faced by health care providers when dealing with employers
- Discuss attendance management programs
- Review case law from courts, human rights tribunals, and arbitrators to distil best practices for managing absenteeism in the workplace
