On June 23, 2023, significant amendments to the Competition Act come into effect.
These amendments, which apply across Canada, will prohibit “wage-fixing” agreements that fix, maintain, decrease or control salaries, wages or terms and conditions of employment and “no-poaching” agreements to not solicit or hire employees between employers. These agreements could constitute a criminal activity and be subject to severe penalties. Employers should make themselves aware of their new responsibilities and restrictions under the Competition Act, and review current practices to ensure compliance.
During this seminar, employers will learn about how these new requirements impact their business, potential pitfalls as the new legislation comes into effect, and how to avoid situations that may constitute a violation of the Competition Act.
During the session, we will explore the following topics:
- Amendments to the Competition Act and statutory defences available to employers
- Situations that are not covered by the legislative amendments, as currently interpreted by the Competition Bureau
- Civil and criminal consequences of these new provisions
- Best practices to be implemented by employer
