Given the media’s interest in judicial activity, how can we reconcile the legal and strategic issues applicable to any litigation in the age of the court of public opinion? Is the sub judice rule a legal basis or mere strategy?
The sub judice rule requires that you refrain from commenting publicly on cases pending before the courts. Comments on the merits or procedure likely to influence a judicial decision or lead to the belief that the impartiality of the court is compromised are prohibited.
Since it is the role of the courts to deal with legal issues that have been brought before them, this role should not be usurped by those who express a public opinion on how these issues should be dealt with. Thus, a judicial decision must be based solely on the legal evidence provided during a trial and protects the right to a fair trial.
