Overview

As society’s understanding of and appreciation for human rights continues to develop and evolve, so does the legal landscape relating to human rights protections for individuals, and correspondingly, the associated risk to organizations.

In this presentation, we will review the continuing shift in approach of Courts and Tribunals in assessing what constitutes discrimination and when organizations will be liable for discrimination. This will include a discussion about recent cases relating to sub-conscious bias and unintentional discrimination as well as family status discrimination. We will also examine how the concept of “welcomeness” in harassment cases has changed to reflect society’s understanding of what is and is not appropriate in the workplace and correspondingly when such conduct constitutes discrimination. Join us to understand what more is expected of both organizations and individuals as a result of the evolving understanding of individual and systemic discrimination.
