On September 22, 2021, the Québec government assented to the Act to modernize legislative provisions as regards the protection of personal information (Law 25, formerly Bill 64).
Law 25, which will gradually come into effect between September 2021 and 2024, significantly modernizes the obligations of private sector businesses and public bodies with respect to protecting personal information. During this presentation, Iara Griffith and Soleïca Monnier will discuss Fasken’s new approach to complying with the changes.
They will reiterate the changes in place, such as the appointment of a Privacy Officer, the publication of their contact information and the management of privacy incidents. They will then address the requirements coming into effect on September 22, 2023, such as the adoption of the governance rules for the protection of personal information, the distribution of plain-language policies, consent and transparency requirements, conducting privacy impact assessments, mandatory contractual clauses, and new rights for affected individuals, including those coming into force in 2024. They will discuss the Commission d’accès à l’information’s increased authority and the consequences of non-compliance with this law, including penal sanctions of up to $25 million or 4% of worldwide sales, whichever is greater.
