2. The complexities of a legal hypothec of construction (builders lien)
Speakers: Mtre Christine Provencher and Mtre Alexandre Belzile
Brief description: The speakers will briefly review the principles of a legal hypothec of construction (known as a builders lien outside of Québec) and dive into legal nuances and potential difficulties using examples from recent case law to demystify this unique tool.
3. Contractor compliance: The importance of managing remedies
Speakers: Mtre Yves Turgeon, Mtre Audrey Charest and Mtre Janouk Charbonneau
Brief description: The consequences of inadequate management of the various civil, penal and administrative remedies can have a decisive impact on a contractor’s right to operate. An outline of the various remedies and recommendations for proactive management will be suggested with regard to the following legislation: Building Act and its regulations, Act respecting occupational health and safety and the Safety Code for the construction industry, Act respecting labour relations, vocational training and workforce management in the construction industry (R-20), regulations and collective agreements, Act respecting contracting by public bodies and its regulations.
