On September 22, 2021, Québec adopted the Act to modernize legislative provisions as regards the protection of personal information (Law 25, formerly Bill 64). The legislative amendments of Law 25 have significant impacts on both public and private sector organizations. While Law 25 amendments come into force gradually, as of September 22, 2023, all changes, save one, are in effect.
Iara Griffith, Soleïca Monnier, and Nareg Froundjian will discuss Fasken’s approach to privacy compliance to ensure your efforts pay dividends. The presenters will begin with a recap of key changes that were in force as of 2022, such as the appointment of a Privacy Officer, the publication of their contact information, and the management of privacy incidents. They will then focus on requirements that came into force on September 22, 2023, such as governance rules for the protection of personal information, plain language policies, consent and transparency requirements, situational privacy impact assessments, mandatory contractual clauses, and new rights for individuals. They will also cover the Commission d’accès à l’information’s increased authority and the consequences of non-compliance, which significantly alters the risk landscape for private sector organizations, with fines skyrocketing from a maximum of $100,000 to the greater of $25,000,000 or 4% of global turnover.
