Canada has seen growth in temporary workers – both foreign and domestic – in the last decade. In this session, we will explore the evolving legal landscape and oft-forgotten rules and regulations governing employers’ use of temporary workers.
Beginning July 1, 2024, the Ontario Employment Standards Act, 2000 (“ESA”) will require temporary help agencies and recruiters to hold a licence to operate. The Ministry of Labour began accepting applications for a license starting July 2023. The Ontario government has also published regulations to help provide further guidance on the amendments. Employers will be prohibited from knowingly using the services of an agency or recruiter if they do not hold a licence. In this session, we will provide an overview of employers’ current obligations under the ESA and its regulations with respect to the use of temporary help agencies and what they will need to know going forward to ensure they are in compliance with the new amendments. We will also take a look at the specific rules governing the hiring of temporary foreign workers.

- Examine the relationship between temporary help agencies and employers
- Review employers’ current obligations with respect to the use of temporary help agencies
- Discuss the upcoming Ontario requirements for licensing requirements for temporary help agencies and to whom it applies
- Examine the rules for employing temporary foreign workers under the Temporary Foreign Worker Program and the International Mobility Program
- Review enforcement activities and potential pitfalls
- Consider potential upcoming regulation or legislation dealing with temporary workers – both foreign and domestic
